2. Scope of Application

These general conditions of sale apply to orders placed through the soluxhotel.com website, unless specific written agreements exist between Falpi Srl and the customer. By placing an order on the website, the customer declares to have read and accepted these terms of sale.

• Consumer customer: a natural person purchasing for purposes unrelated to their business, commercial, craft or professional activity.
• Professional customer / reseller: an entity purchasing within the scope of their business, commercial, craft or professional activity. Resellers are registered users who purchase under reserved commercial conditions; for them, the provisions of art. 19 apply.

3. Items Sold

The items produced and marketed by Falpi Srl comply with safety requirements and are suitable exclusively for the use for which they were designed.

Data, weights, descriptions, images, colours, and representations of the products on the website are indicative and subject to change; measurement tolerances are regulated by applicable standards. Images and drawings are for illustrative purposes and may differ from the actual product in terms of colours, finishes, accessories, or technical details.

Falpi Srl reserves the right to make technical, aesthetic, or functional changes to its items, without prior notice and at any time, without altering their main intended use.

4. Prices and Currency

Prices on the website are expressed in Euros (€) and, for consumer customers, are indicated inclusive of VAT.

Any shipping costs or other applicable costs are indicated during checkout before order confirmation and payment.

Falpi Srl reserves the right to change prices at any time. The price applied to the customer will be that indicated on the website at the time of order confirmation, except for obvious errors or technical malfunctions. Any promotions or discounts are valid only within the limits and for the period indicated.

For professional customers and resellers, prices may be indicated net of VAT and according to the reserved conditions provided for in art. 19.

5. Orders

Every order placed through the website implies acceptance of these terms of sale. After completing the purchase, the customer will receive a confirmation email with an order summary.

Falpi Srl will manage the order according to the times and methods indicated on the Shipping and Returns page and in the communications sent to the customer, and may contact the customer to request additional information (personal, tax, billing or delivery details).

Any requests for order modification or cancellation can be promptly communicated to ordini@falpi.com and will be evaluated based on the order's preparation status. The rights recognised to consumer customers by current legislation remain unaffected.

6. Payments

Payment is made in Euros (€) using the methods available during checkout, including credit or debit cards, PayPal, and Klarna.

The order will be processed after payment confirmation, unless otherwise agreed in writing between Falpi Srl and the customer.

7. Shipping and Delivery

Items are shipped by courier. Shipments through the website are currently available in Italy, with free shipping; for international shipments, please refer to the Shipping and Returns page.

Delivery times, shipping costs, serviced areas, any exclusions and surcharges are indicated on the Shipping and Returns page and/or during checkout. Items are delivered to the carrier intact and in packaging suitable for the nature of the product.

Delivery times are estimated and not mandatory. Any delays in delivery do not authorise delays in agreed payments or legitimate claims for compensation, unless otherwise mandatorily provided by applicable legislation.

8. Inspection of Goods upon Delivery

Upon receipt of the goods, the customer is invited to check:

• that the number of packages delivered corresponds to what is indicated in the transport document;
• that the packaging is intact and unaltered, including the sealing tapes;
• that the goods do not show obvious damage.

In case of damaged, tampered with, or non-intact packaging, the customer is invited to accept the goods with a specific reservation, indicating the problem on the courier's document. Any transport damage must be promptly reported to ordini@falpi.com, preferably within 7 days of receipt, attaching photographs of the packaging and the product.

9. Usage Instructions

Products must be used exclusively for the purpose for which they were designed. Falpi Srl is not liable for breakdowns, damage, or malfunctions caused by improper use of the items, failure to follow instructions, lack of normal maintenance, tampering, alteration, or use not conforming to the product's intended purpose.

10. Complaints and Defects

The customer is required to inspect the goods upon receipt and report any defects, damage, or shortages in writing to ordini@falpi.com. Solely verbal or telephone complaints will not be considered valid.

For consumer customers, the rights provided by the legal guarantee of conformity and applicable legislation remain unaffected.

11. Returns and Right of Withdrawal

The conditions related to returns, right of withdrawal, return costs, address to which to send the goods, and refund methods are indicated on the Shipping and Returns page.

For consumer customers, where applicable, the right of withdrawal can be exercised within 14 days from the delivery of the goods. To exercise it, the customer can fill out the form available on the Withdrawal Form page.

The right of withdrawal does not apply to custom-made, personalised, or configured products according to specific customer requests, in cases provided for by applicable legislation.

12. Custom or Made-to-Order Products

Some products can be manufactured, modified, or configured according to specific customer requests — for example, the application of customer brands, logos, or stickers, or non-standard configurations.

In the case of products customised or configured according to the customer's instructions, the right of withdrawal does not apply, except in the case of a defective or non-compliant product. The customised nature of the product is indicated on the product page before purchase.

Standard catalogue models, even if assembled to order according to a standard configuration, remain subject to the right of withdrawal.

To request customisation of trolleys with their brand, logo, or stickers, customers can contact Falpi Srl at marketing@falpi.com.

13. Failure to Collect

In case of failure to collect the goods by the customer, Falpi Srl reserves the right to charge any storage, redelivery, return, or handling costs incurred. The rights recognised to consumer customers by applicable legislation remain unaffected.

14. Liability

Falpi Srl is not liable for damages caused by improper use of products, failure to follow assembly, use, maintenance, or washing instructions, or by tampering with or altering the items. The mandatory rights recognised to consumer customers by applicable legislation remain unaffected.

15. Legal Guarantee

Products sold through the website are covered by the legal guarantee of conformity. For consumer customers, the guarantee has a duration of 24 months from the delivery of the goods, as provided by the Consumer Code.

In case of a defective or non-compliant product, the customer can contact Falpi Srl at ordini@falpi.com, indicating the order number and describing the problem encountered.

16. Use of Images, Photographs and Content

The images, photographs, drawings, and any other representations of Falpi Srl items present on the website, in catalogues, price lists, brochures, and advertising materials are the property of Falpi Srl or used with permission.

It is forbidden to use, reproduce, modify, or disseminate such content by customers or third parties without the express written authorisation of Falpi Srl. The marketing or publication, in any form and by any means, of Falpi Srl items by customers or third parties cannot be carried out anonymously, unless otherwise authorised in writing.

17. Trademarks

The Falpi Srl brand, where present on the items, cannot be cancelled, covered, or made invisible. The Falpi brand and the word Falpi are registered and owned by Falpi Srl. Use of the Falpi brand is allowed only with prior written authorisation, unless otherwise agreed.

Any requests regarding the use of the Falpi brand or the customisation of products (brand, logos, stickers) can be sent to marketing@falpi.com.

18. Personal Data

Customer personal data are processed in compliance with applicable personal data protection legislation. For more information, the customer can consult the Privacy Policy available on the website.

19. Professional Customers and Resellers

Purchases made by professional customers and registered resellers are governed by reserved commercial conditions and by the relevant agreement signed with Falpi Srl, which regulates, among other things, prices and discounts, payment terms and conditions, retention of title, default interest, minimum quantities, guarantees, and competent court.

In case of conflict between these general conditions and the reserved conditions, the latter prevail for professional customers and resellers.

20. Applicable Law and Jurisdiction

These conditions are governed by Italian law.

For consumer customers, the court of the consumer's place of residence or domicile is exclusively competent, where provided for by applicable legislation. For professional customers and resellers, the competent court is indicated in the reserved conditions referred to in art. 19.

21. Acceptance of General Conditions

By submitting the purchase order, the customer declares to have read and accepted these general conditions of sale.
